Writ Petition (Criminal) filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 1st and 2nd respondents to provide adequate police protection to the petitioner and her family members as against the 3rd respondent and her rowdy gangs while running the petitioner shop in a peaceful manner as mentioned in the affidavit, by considering the petitioner's representation dated 24.11.2025.

ORDER
This writ petition (criminal) has been filed seeking to direct the 1st and 2nd respondents to provide adequate police protection to the petitioner and her family members as against the 3rd respondent and her rowdy gangs while running the petitioner's shop in a peaceful manner, by considering her representation dated 24.11.2025.
2. Mr.M.V.Ramachandra Murthy, learned Public Prosecutor (Puducherry) takes notice on behalf of the 1st and 2nd respondents. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself.
3. Since no adverse order is passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.
4. Learned counsel for the petitioner submitted that the petitioner is running an electronic products sales and service shop at R.S.No.97/2, Uzhavarkarai Village, Puducherry. While so, on 26.08.2025 at about 08.50 p.m., the 3rd respondent, along with a gang of rowdy elements, broke open the petitioner's shop and committed theft of electronic materials and damaged electronic products worth about Rs.25 lakhs. Aggrieved by the same, the petitioner made a complaint against the 3rd respondent before the 2nd respondent on 26.08.2025, pursuant to which, the 2nd respondent registered an FIR in Crime No.174 of 2025 dated 28.08.2025 for the offences under Sections 189(2), 329(3), 305(a), 324(5), 296(b), 351(2) and 190 of the BNS, 2023.
While so, once again the 3rd respondent had come to the petitioner's house and also waylaid her on her way home and threatened her with dire consequences and coerced her to withdraw the police complaint. Hence, the petitioner made a representation dated 24.11.2025 before the 1st and 2nd respondents seeking to provide adequate police protection to her and her family members as against the 3rd respondent and her rowdy gangs while running her shop. However, till date, no action has been taken by the respondent police on her representation. Accordingly, he prayed for appropriate orders.

Learned Public Prosecutor appearing for the 1st and 2nd respondents fairly submitted that the petitioner's representation dated 24.11.2025 has been received by the 2nd respondent and preliminary enquiry will be conducted on the said representation and if any prima facie case is made out, necessary police protection will be provided to the petitioner by the respondent police.
