Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus to call for the impugned Registered Trust Amendment Deed dated 11.11.2025 registered as Document No.74/2025 on the file of the 3rd respondent herein, quash the same and direct the 3rd respondent herein to conduct enquiry as contemplated under Sec.34 of the Registration Act.

ORDER

The petitioner asserts that he is the chairman of the petitioner trust and that such trust is undertaking significant charitable activities. According to the petitioner, the fifth respondent unilaterally passed a resolution on 19.01.2024 and inducted respondents 6 to 15 as trustees. Pursuant thereto, the trust amendment deed dated 11.11.2025 was executed and registered as document no.74/2025. In those circumstances, the petitioner seeks the quashing of the registered trust amendment deed dated 11.11.2025 and further enquiry under Section 34 of the Registration Act, 1908.

2. Learned counsel for the petitioner submits that the private respondents herein are endeavouring to operate the bank account of the trust with the fourth respondent bank on the basis of the fraudulent and invalid trust amendment deed.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for respondents 1 to 3.

4. The official respondents herein do not have the power to cancel the trust amendment deed dated 11.11.2025. The grievance of the petitioner is in relation to a resolution dated 19.01.2024 inducting respondents 6 to 15 as trustees. The appropriate forum to consider the validity of the above mentioned resolution and the execution of trust amendment deed dated 11.11.2025, on such basis, is the jurisdictional civil Court. Therefore, by leaving it open to the petitioner to approach the jurisdictional civil Court for relief, this writ petition is disposed of without any order as to costs. Consequently, connected miscellaneous petitions are closed.
