Civil Miscellaneous Petition filed under Section 148 of C.P.C., to pass an order of extension of time for three months to comply with the order dated 15.10.2025 in C.M.P.No.24928 of 2025 in Arbitration Appeal No.53 of 2025 to deposit the entire amount, along with accrued interest and costs, in the account of O.P.No.747 of 2016.

ORDER

(Order of the Court was made by C.V.Karthikeyan J.) On 15.10.2025, a co-ordinate Division Bench of this Court had passed an order in CMP.No.24928 of 2025 and the same is extracted hereunder: "Notice to the respondent returnable in six weeks. Private notice is also permitted.

2. There shall be an order of interim stay, on condition that the petitioner/appellant shall deposit the entire award amount, along with interest and costs in the account of O.P.No.747 of 2016, within a period of six weeks from today.

3. Post the matter after six weeks. "

2. This Civil Miscellaneous Petition has been filed, seeking extension of time for a further period of three months to comply with the said order.

3. In the affidavit filed in support of this miscellaneous petition, it had been contended that the Chief Engineer (H) Construction and Maintenance, Chennai, has recommended the said proposal to the Government on 12.11.2025. It had been further stated that the proposals have to be routed from Highways and Minor Ports Department to the Advisory Departments of the Government namely Finance Department and Law Department, as per the Business Rules of Secretariat.

4. It is therefore stated that since the said procedure would take some more time, further time may be granted to deposit the entire amount as directed.

5. Heard the learned Additional Advocate General for the petitioner and also the learned counsel for the respondent.

6. Taking all factors into consideration and particularly the date of the order of the award, we would grant time till 17.02.2026 to comply with the directions issued on 15.10.2025, failing which, the interim stay granted by this Court would stand automatically vacated.

7. Accordingly, the Civil Miscellaneous Petition in CMP.No.30200 of 2025 in C.M.P.No.24928 of 2025 in Arb.Appeal No.53 of 2025 stands disposed of.
