Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorari, to call for records of the impugned demand notice dated 08.07.2025,bearing Na.Ka.3009/2025/A3,passed by the 3rd respondent, pertaining to the lease granted in favour of the petitioners erstwhile Partnership firm and another lease granted in favour of Petitioners husband Late Mr.S.A.Ganeshun, and quash the same as illegal and arbitrary. ORDER
This petition has been filed seeking to quash the impugned demand notice dated 08.07.2025, bearing Na.Ka.3009/2025/A3, passed by the 3rd respondent,
pertaining to the lease granted in favour of the petitioners erstwhile Partnership firm and another lease granted in favour of Petitioners husband Late Mr.S.A.Ganeshun.
2. The learned counsel for the petitioner submitted that as against the impugned order, there is an effective appeal remedy available before the first respondent under Rule 36(c) of the Tamil Nadu Minor Mineral Concession Rules, 1959. Hence, this Court without going into the merits of the case, permit the petitioner to make appeal before the first respondent.
3. The learned Standing Counsel appearing for the respondents have not raised any objection in this regard.
4. Heard the learned counsel for both side and perused the materials available on record.
5. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court, without interfering with the impugned order, permits the petitioner to prefer appeal as against the impugned order passed by the third respondent, within a period of two weeks from the date of receipt of a copy of this order. Upon filing the same, the first respondent shall entertain the same and pass appropriate orders within the period of six weeks thereafter.
