ORDER

This Writ Petition (Criminal) has been filed seeking a direction, directing the 2nd respondent to provide police protection to the petitioner's property viz., Survey No.98/2 [as per patta sub-divided new Survey No.98/2A], measuring to an extent of 5.5 cents [or] 2400 sq.ft [out of 1.15 Acres] of land, bearing Door No.5, Anjaneyar Street, Karthikeyan Nagar, Maduravoyal, Chennai - 600 095, situated at No.99, Maduravoyal Village, Maduravoyal Taluk, Chennai District and bounded on the North by land in Survey No.98/2A1B, South by - land in Survey No.98/2D1, East by - land in Survey No.98/2D and West by - Anjaneya Street[Road], within the Sub-Registration District of Virugambakkam and Registration District Chennai - South, based on the representation dated 28.03.2025 to the 1st respondent.

Heard the learned counsel for the petitioner and the learned Counsel for Government of Tamil Nadu (Crl.Side) appearing for the respondents 1 and 2. Perused the materials available on record.

On perusal of records revealed that the 4th respondent herein has already filed a suit in O.S.No.299 of 2015 before the Principal District Munsif Court, Poonamallee, for declaration and permanent injunction in respect of the very same subject property and the same got dismissed on 14.06.2022. After dismissal of the suit, the 5th respondent lodged a complaint before the 2nd respondent, alleging that the petitioner is disturbing her possession and enjoyment of the subject property. At the same time, the petitioner also lodged a complaint alleging that she is in possession and enjoyment of the subject property. The suit filed by the 4th respondent herein was dismissed in toto.

In view of the above, the 2nd respondent is directed to conduct an enquiry on the complaint lodged by the petitioner, as well as the complaint lodged by the 5th respondent, after issuing notice to the petitioner and the respondents 3 to 5, and pass orders with regard to provide adequate police protection, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
