ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.06.2025 for the offences punishable under Sections 127(2) of BNS, 2023 and Section 5(m) r/w Section 6 of POCSO Act, in Crime No.68 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner is known to the victim's family while the victim girl was 4 years old and the petitioner took her to lonely placed committed aggravated penetrative sexual assault. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner have been falsely implicated in this case and the petitioner is in judicial custody since 05.06.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that investigation is completed, final report filed, if the bail is granted to the petitioner he will tamper 2/4

the evidence, since the case is posted for opening of prosecution before the trial Court, and considering the fact that it is the case of aggravated penetrative sexual assault and opposed for grant of bail to the petitioner.

I have also gone through the FIR, the manner in which the occurrence had taken place, considering the age of the victim, if the petitioner is released on bail he will tamper the evidence and hamper the trial process, hence this Court is not inclined to grant bail to the petitioner at this stage.
