... Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records in respect of the Ref. No. 90288/N1/2025 on 21.11.2025 impugned order issued by the 2nd respondent, quash the same and direct the 2nd respondent to transfer from Rajiv Gandhi Medical College Hospital, Chennai to Government Medical College Hospital, Thoothukudi District, at present the petitioner is working on Diversion duty.

O R D E R

This Writ Petition has been filed challenging the order dated 21.11.2025 passed by the 2nd respondent, thereby cancelling the diversion order issued in respect of the petitioner from Rajiv Gandhi Medical College Hospital, Chennai, to the Government Medical College Hospital, 2/6

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner is a Staff Nurse at Rajiv Gandhi Government Medical College and Hospital, Chennai. At present, she is working on diversion at Government Medical College Hospital, Thoothukudi District, from 05.10.2017. While being so, the 2nd respondent cancelled the diversion order issued in respect of the petitioner and directed her to report for duty at her original place of posting, namely, Rajiv Gandhi Medical College and Hospital, Chennai.

It is seen that the petitioner's deputation/diversion was cancelled in accordance with the minutes of the meeting dated 22.10.2025, convened under the Chairmanship of the Principal Secretary to the Government, Health and Family Welfare Department. A perusal of the minutes reveals that the Director of Medical and Rural Health Services, Director of Medical Education and Research, and Director of Public Health and Preventive Medicine were directed to identify all Staff Nurses who have been on diversion/deputation for more than four years (i.e., prior to May 2021) and to cancel their diversion/deputation orders 3/6

immediately. In view of the same, this Court is not inclined to entertain the present writ petition.

5. However, Mr.Father Xavior Arulraj, learned Senior counsel appearing for the petitioner submitted that the petitioner's elder daughter is studying in the 10th Standard in a school at Thoothukudi.

6. Considering the above submission, the respondents are directed to implement the impugned order from the month of June, 2026. Till then, the respondents are directed to permit the petitioner to continue to work in the present station i.e. Government Medical College Hospital, Thoothukudi.

7. With the above directions, this Writ Petition stands dismissed. Consequently, the connected Miscellaneous Petitions are closed. No costs.
