ORDER
The petitioner had purchased a property in S.No.181/33 under sale deed dated 06.09.2024, which was registered as document no.6200/2024. Upon realising that the survey number had been inadvertently omitted from the schedule, the petitioner's vendor executed rectification deed dated 18.12.2024. After examining the encumbrance certificate and finding that the survey number had not been incorporated on account of not updating the same while generating the TP number in relation thereto, the petitioner submitted representations on 30.12.2024 and 28.02.2025. The present writ petition relates thereto.
2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents. He submits that the encumbrance certificate does not reflect the survey number on account of the petitioner not incorporating the
same while making the online application. If a fresh representation were to be submitted along with rectification deed, he submits that necessary action would be taken within three weeks from the date of such representation.
3. Considering the above submissions, this writ petition is disposed of on the following terms:
(i) The petitioner shall submit a fresh representation seeking rectification of the encumbrance certificate by enclosing a copy of the rectification deed dated 18.12.2024.
(ii) Such representation shall be submitted to respondents 2 & 3 within two weeks from the date of receipt of a copy of this order. (iii) Within three weeks from the receipt thereof, the third respondent is directed to take necessary measures to rectify the entry in the encumbrance certificate relating to rectification deed dated 18.12.2024 bearing document no.8606/2024.
There will be no order as to costs.
