This criminal original petition has been filed seeking to quash the 1/5

proceedings in C.C.No.360 of 2024 on the file of the learned Judicial Magistrate No.I, Villupuram, Villupuram District.

2. Based on the complaint given by the second respondent / de facto complainant, the first respondent police registered a case in Cr.No.216 of 2024 against the petitioner and two others for the alleged offences under Sections 294(b), 447, 427, 353 and 506(ii) of IPC, 1860. Upon completion of investigation, the first respondent filed a charge sheet for the offences punishable under Sections 294(b), 447, 427 & 506(ii) of IPC, 1860 which was taken cognizance by the learned Judicial Magistrate No.I, Villupuram, Villupuram District in C.C.No.360 of 2024. Aggrieved by the same, the present petition has been filed.

3. The learned counsel for the petitioner submits that there is civil litigation pending between the parties. However, due to previous enmity, a false complaint has been given against the petitioner. He further submits that the allegations made in the charge sheet are purely false and baseless.

4. Per contra, learned Government Advocate (Crl.Side) appearing for the first respondent police submits that the petitioner and the other accused have abused and intimidated the de facto complainant and caused 2/5

damage to the house and the CCTV camera. There are materials against the petitioner. The case now stands posted for examination of witnesses on 02.02.2026. Hence, he prayed to dismiss this petition.

5. At this juncture, the learned counsel for the petitioner prayed for the indulgence of this Court, to dispense with the personal appearance of the petitioner before the trial Court.

6. Heard the learned counsel appearing on either side and perused the materials available on record.

7. In view of the submissions made by the learned Government Advocate (Crl.Side) that there are prima facie materials on record to proceed against the petitioner and considering the stage of the proceedings, which is now posted for examination of witnesses on 02.02.2026, this Court finds no ground to interfere with the impugned proceedings under Section 482 of Cr.P.C. However, the personal appearance of the petitioner before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court. The petitioner shall be duly represented by his counsel before the trial Court on all hearing dates 3/5

before the trial Court.
