O R D E R
This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the order passed in Rc.21210/2021/A3 dated 05.08.2022 by the first respondent and to quash the same and further to direct the respondent to return the service benefits and arrears of salary withheld at the time of suspension to the petitioner.
2.The learned counsel appearing for the petitioner submitted that on the allegation that the petitioner while serving as Special Tahsildar (LA), SIPCOT, Sriperumbudur Expansion Scheme - II, (Unit-4) Sriperumbudur was responsible for sanctioning compensation amount for OSR lands earmarked for park and roads mentioned in the layouts situated in Vadagal - A Village S.No.137, Vadagal - B Village S.No.142 and etc., Vallam - B Village S.No.282 and etc., of 2/6
Sriperumbudur Taluk, Kancheepuram District, thereby caused loss to the Government, the petitioner was arrested and sent to judicial custody and was subsequently, suspended from service since the petitioner was inside prison for more than 48 hours, vide proceedings of the first respondent dated 05.08.2022. Thereafter the petitioner made representation for revocation of suspension, however, there is no response.
3.The learned counsel appearing for the petitioner further submitted that prolonged suspension is impermissible as per the principles laid down by the Hon'ble Apex Court in Ajay Kumar Choudhary Vs. Union of India [(2015) 7 SCC 291] and further submitted that till date, disciplinary proceedings was not initiated against the petitioner and other officials. The learned counsel further submitted that this Court may, without going into the merits of the case, permit the petitioner to make fresh representation to the respondents seeking revocation of suspension and issue direction to the respondents to consider the same and to pass appropriate orders. 4.The learned Special Government Pleader submitted that the Commissioner, Revenue Administration has taken effective steps to 3/6
initiate disciplinary proceedings against the petitioner and other officials and has informed to the District Collector, however, if the petitioner makes fresh representation for revocation of suspension, the same will be considered and appropriate orders will be passed. 5.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court without expressing any opinion on the merits of the case, permits the petitioner to make fresh representation to the respondents seeking revocation of suspension. On receipt of such representation, the respondents shall consider the same, on merits and in accordance with law and pass appropriate orders, as expeditiously as possible.
6.The writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions are closed. 19.12.2025 pri Index: Yes/ No Speaking Order: Yes/ No NCC: Yes/ No 4/6
