O R D E R
The petitioner, who was arrested and remanded to judicial custody on 15.10.2025, for the alleged offence punishable under Sections 302, 120B, 294(b), 149, 351 of IPC r/w 4 of TNPHW Act, in Crime No.201 of 2023, on the file of the respondent police, seeks bail. 1/4
2. The allegation against the petitioner is that he was involved in a case of murder and was earlier arrested and released on bail. Subsequently, during the pendency of the committal proceedings, he jumped bail; hence, a Non-Bailable Warrant (NBW) was issued against him on 15.06.2024. The warrant was later executed on 15.10.2025. Since the petitioner had continuously absconded, a Look-Out Circular (LOC) was issued, and when the petitioner attempted to go abroad, he was detained on the strength of the LOC, and the NBW was thereafter executed on 15.10.2025.
3. Learned counsel appearing for the petitioner submitted that the petitioner has now been arrested, the case has been committed to the Sessions Court, and the matter is pending for trial. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner had earlier jumped bail, pursuant to which a Non-Bailable Warrant was issued on 15.06.2024. He further submitted that despite several steps taken to secure his presence, the petitioner did not appear, and subsequently, on the basis of the Look-Out Circular, he was detained at the airport and arrested on 15.10.2025. Hence, he opposed for the grant of bail to the petitioner.
5. Considering the above facts, the submissions made by the learned counsel on either side, and the fact that although the case has been 2/4
committed to the Sessions Court, the petitioner is also facing another case under Section 302 IPC, this Court is of the view that, at this stage, if the petitioner is released on bail, there is a likelihood that he may again jump bail. Therefore, this Court is not inclined to grant bail to the petitioner.
