O R D E R

The petitioner, who was arrested and remanded to judicial custody on 22.06.2025, for the offences punishable under Section 8(c), 20(b)(ii)(c) of NDPS Act in Crime No.136 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegations against the petitioner is that the petitioner was found transporting 21 kgs of ganja and he was intercepted by the respondent police on 23.06.2025 and after all compliance of mandatory provisions, the same was recovered and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner is in custody from 23.06.2025 and he is not having any previous case and there is no passibility of tampering the witness. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) reported that the seized contraband is 21 kgs of ganja which is a commercial quantity, section 37 of NDPS Act is applicable and so far, no grounds have been made out for satisfying the 1st condition that the petitioner is not guilty of offence. Hence, he strongly opposed to grant bail to the petitioner.

5. I have gone through the FIR and other connected records, which revealed that the petitioner was arrested with contraband near Vadapalani Bus Stand and it is also stated that it was transported from Odisha. The petitioner has not made out any grounds to satisfy Twin Conditions of 2/4

Section 37 of NDPS Act. Hence, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 02.12.2025 mpa To 1.The Inspector of Police, PEW St.Thomas Mount Unit, Chennai-PEW South.
