ORDER
The Civil Revision petition is filed seeking early disposal of the suit in OS.No.457 of 2023 on the file of the Sub Court, Chidamabaram.
2. The petitioner is the second defendant in the suit. The first respondent filed a suit for partition against the petitioner and other respondents.
3. The learned counsel for the petitioner submitted that defendants 1 and 2 already filed written statement, the defendants 3 and 5 were set ex-parte and the 4th defendant is no more. It is also stated that the 5th defendant is the daughter of 4th defendant. Therefore, the legal representative is already on record. However, the plaintiff failed to amend the plaint so as to record that the 5th defendant as the legal representative of the deceased 4th defendant.
4. It is seen from the adjudication papers filed in the typed set of papers that the suit has been adjourned from 20-11-2024 onwards for the purpose of taking steps to bring on record the legal representatives of the deceased 4th defendant. Even though one of the legal representatives of the deceased 4th defendant is already on record, till date no steps have been taken by the plaintiff to record available heir as legal representative. Therefore, there is no progress in the suit for the past 13 months.
5. In view of the same, this Court directs the trial court to dispose of the suit as expeditiously as possible.
6. With this direction, the civil revision petitions stands disposed of. No costs.
