The petitioner herein, who was arrested and remanded to judicial custody on 26.11.2024 for the offences punishable under Sections 8(c), 20(b) (ii)(C) of the NDPS Act in Crime No.712 of 2024, registered on the file of the respondent police, seeks bail. This is the successive bail application of the petitioner and the earlier bail application of the petitioner was dismissed by this Court, vide order dated 27.10.2025 in Crl.O.P.No.29089 of 2025 on the following reasons:

"3. This Court dismissed the earlier bail application of the petitioner on merits and also considered the very same points raised by the learned counsel for the petitioner and since there is no change of circumstances after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.19836 of 2025, once again revisiting the very same points is not permissible, hence this Court is not inclined to grant bail to the petitioner."

The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 26.11.2024; that the co-accused/ Ravi @ Powder Ravi in this case has been granted bail by this Court, vide order dated 27.11.2025 in Crl.O.P.No.25852 of 2025 and the other coaccused/ L.Ravi was granted bail by this Court, vide order dated 05.03.2025 in Crl.O.P.No.6154 of 2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the 2/4

petitioner.

Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

I have considered the submissions made on both sides and perused the materials available on record. The co-accused in this case was granted bail by this Court in Crl.O.P.No.25852 of 2025 on the ground that, his name was included only based on the confession statement of other accused and also the fact that there was no telephonic conversation between the petitioner therein and the other accused, hence the parity cannot be claimed by the petitioner herein for grant of bail. Further, in this case the recovery of contraband is made from the petitioner herein. 5.

In view of the above and considering the fact that, the earlier bail application of the petitioner herein was dismissed on merits and there is no change in circumstances after the dismissal of the earlier bail application of the petitioner in Crl.O.P.No.29089 of 2025, this Court is not inclined to grant bail to the petitioner.
