ORDER
The writ petition has been filed for a direction, directing the respondents 2 to 4 to consider the petitioners representation dated 22.10.2025 and thereby forbear the respondents 2 to 4 from disconnect the electricity service connection No 08-011030-2602 stands in the name of petitioner in Survey No.647/2G presently Survey No.647/2G2A, Balajaganahalli post, Nallampalli Taluk, Dharmapuri District.

It is the contention of the petitioner the petitioner and fifth respondent's father had ancestral property, wherein, electricity connection was given in respect of the property and vide oral partition, the property was alloted to the petitioner's father. Now, the fifth respondent filed a writ petition in WP.No.6859 of 2023 seeking to disconnect the existing electric service connection and this Court by order dated 03.06.2025 directed the fourth respondent to conduct an enquiry by affording opportunity to the petitioner therein and the fifth respondent therein. Therefore, according to the petitioner, now the fifith respondent's application is considered and the official respondents are trying to disconnect the electricity connection. Hence, seeks for a direction.

3. whereas, the learned standing counsel for the respondents, on instructions, submitted that both the petitioner and the fifth respondent have not produced any documents to establish the title and only on ascertaining the title, action will be taken. It is also stated by both sides that the petitioner as well as the fifth respondent have filed different suits. The petitioner's father has filed a suit in O.S.No.35 of 2022 on the file o the District Munsif, Dharmapuri, now transferred and renumbered as O.S.No.17 of 2025 on the file of the Principal Sub Judge, Dharmapuri for declaration and permanent injunction against the fifth respondent and others. Similarly, the fifth respondent and his father has filed a suit in O.S.No.56 of 2025 on the file of the District Munsif Court, Dharmapuri for injunction.
4. Heard both sides and perused the materials placed on record. By consent of both sides, this writ is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the private respondent, notice to the private respondent is dispensed with.
5. Since civil suits are pending and the possession is also is in dispute, let the civil suits be decided first and based on the decree and judgment, the official authorities shall take further action in this regard. Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
