ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.10.2025 for the alleged offence punishable under Sections 204, 319(2) in Crime No. 249 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 19.11.2025 in Crl.O.P.No.31623 of 2025, on the following grounds: "6. I have also gone through the records and connected FIR. This petitioner posing himself as a police party intercepted the de-facto complainant and snatched a bag containing cash of Rs.55 lakh. Further, during the course of investigation, a sum of Rs.1 lakh only recovered from this petitioner and that the investigation is pending. 7.Considering the above facts and circumstances of the case, the submissions made by the learned Counsel on either side, this Court is not inclined to grant bail to the petitioner."

3.The learned Counsel for the petitioner submits that some of the coaccused were arrested and released on bail in Crl.M.P.No.10725 of 2025, dated 06.11.2025 and Crl.M.P.No. 11647 of 2025, dated 06.12.2025 on the file of Principal Sessions Judge, Chennai.

4. By an earlier order in Crl.O.P.No.31623 of 2025, dated 19.11.2025, the bail application of the petitioner herein was dismissed, and while granting bail to another co-accused the learned Sessions Judge vide order dated 06.12.2025, was not brought to the knowledge about the dismissal order passed by this Court dated 19.11.2025. Hence, I am of the view that the Public Prosecutor has properly submitted the orders passed by this Court before the Sessions Court, Chennai.

Further, in this case, a huge amount has been involved, and so far, only Rs.7,00,000/- has been recovered.

5. Considering the fact that there is no change in circumstances in this petition, and this Court is not inclined to grant bail to the petitioner. dismissed. 09.12.2025 MSM To
