ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.11.2025 for the offences punishable under Sections 296(b), 75(2), 351(2) of BNS Act and under Section 4 of TNPHW Act in Crime No.339 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 25.11.2025 in Crl.O.P.No.32205 of 2025 for the following reasons: "5. I have also gone through the FIR and considering the submissions of the learned Government Advocate (Crl. Side) that videos of the victim was already recorded, it was captured without the knowledge of the victim, and she has also been threatened by the petitioner and other accused, this Court is not inclined to grant bail to the petitioner at this stage." 2.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 05.11.2025; that co-accused/ A2 was granted anticipatory bail by the Principal Sessions Judge, Krishnagiri, vide order dated 07.11.2025 in Crl.M.P.No.3018 of 2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner.

Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

Considering the submissions made, facts and circumstances of the case, the nature of offence, the fact that the present bail petition has been filed immediately after the dismissal of the earlier bail application of the petitioner in Crl.O.P.No.32205 of 2025 without any change in circumstances, this Court is not inclined to grant bail to the petitioner. 5.
