PRAYER: This Criminal Miscellaneous Petition has been filed to modify the conditions i.e. to deposit a sum of Rs.50,000/- to the credit of SC No.43 of 2018 on the file of Sessions Judge, Magalir Needhi Mandram, (FAST TRACK Mahila Court) Trippur without prejudice his defence within a period of 3 weeks from the date of receipt of copy of the order and further another condition by modifying to execute a bond for sum of Rs.10,000/- with two sureties instead of to execute a bond for a sum of Rs.25,000/- imposed in the order passed in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 by order dated 06.11.2025.

ORDER

The petition seeks to modify two conditions imposed by this Court while granting Suspension of Sentence in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 by an order dated 06.11.2025.

2. According to the petitioner, he has been in custody for more than 3 1⁄2 years and since he is unable to comply with the first condition imposed by this Court, namely to deposit a sum of Rs.50,000/- (Rupees Fifty Page No.2 of 6

Thousand Only), he is unable to execute the sureties and he is still languishing in jail inspite of the order passed by this Court in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 on 06.11.2025.

3. Heard the learned Additional Public Prosecutor for the respondent.

4. Considering the fact that the petitioner is still in jail inspite of the order passed by this Court in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 dated 06.11.2025 and he has been in custody since 21.10.2021, the first condition, i.e., 5(a) imposed by this Court in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 is modified with a direction to deposit a sum of Rs.5,000/- (Rupees Five Thousand Only) and the second condition, i.e., 5(b) imposed by this Court is modified with a direction to execute a bond for Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties for the likesum to the sanctification of the Spl.S.C.No.43 of 2018 on the file of the Sessions Judge, Mahalir Neethimandram, FTMC, Tiruppur. 5. The other conditions imposed in the order dated 06.11.2025 in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 shall remain unaltered.

6. Accordingly, the criminal miscellaneous petition is ordered, and the conditions are modified.

7. Further, the time to execute sureties and to comply with the conditions imposed on the petitioner by this Court in Crl.M.P.No.20724 of 2025 in Crl.A.No.51 of 2024 dated 06.11.2024 is extended by two weeks from the date of receipt of a copy of this order. It is made clear that no further extension of time will be granted.
