ORDER
After submitting representation dated 04.11.2025 requesting the Registering Officer not to register any documents pertaining to an extent of 3.59 Acres in Survey No.283 of Marupalli Village, Denkanikottai Taluk, Krishnagiri District, the present writ petition has been filed.
2. Learned counsel for the petitioner submits that one Munian Boyi registered Document No.1414 of 1983 and that, except the executant, nobody had knowledge about the said execution. He also points out that a subsequent document bearing Document No.1083 of 1994 was registered. Therefore, after submitting representation dated 04.11.2025, he submits that the present writ petition has been filed to restrain the 1st respondent from registering documents relating to the property.
3. Ms.Akila Rajendran, learned Government Advocate, accepts notice for both the respondents. On the basis of written instructions, she submits that no document for registration in respect of Survey No.283 was received after the date of receipt of representation dated 04.11.2025. If any document is received, she submits that the protest petition would be considered in accordance with the Registration Rules.
4. The Registering Officer is under a statutory obligation to consider a request for registration of documents in accordance with the Registration Act,
1908. Therefore, a Mandamus restraining the Registering Officer from performing a statutory duty cannot be issued. The petitioner appears to have lodged a protest with regard to any perspective registrations. Such protest petitions may be dealt with in accordance with Rules 54 and 55 of the Registration Rules.
