ORDER

The petitioner, who was arrested and remanded to judicial custody on 10.10.2025 for the offences punishable under Sections 363, 354 D, 506(i) of IPC r/w 3(a), 4 of POCSO Act, 2012 in Crime No.53 of 2025, registered on the file of the respondent police, seeks bail. This is the second bail application of the petitioner and the earlier bail application of the petitioner was dismissed by this Court, vide order dated 05.11.2025 in Crl.O.P.No.30137 of 2025, on the following reasons: "5.

Considering the submissions made on both sides and perused the materials available on record, including the statement recorded from the victim girl, which reveals disturbing facts and the involvement of the petitioner herein in the offence and taking note of the fact that the investigation is not included, this Court is not inclined to grant bail to the petitioner." 2.

The learned counsel appearing for the petitioner submitted that the alleged occurrence of sexual assault took place in the year 2023 and the complaint was lodged belatedly in the 2025; that the petitioner is in custody since 10.10.2025; that after the dismissal of the earlier bail application of the petitioner, the investigation of the case was completed and final report filed; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the investigation of the case was completed and now the final report has been filed and the same is yet to be numbered. 4.

I have considered the submissions made on both sides and perused the materials available on record. Though, the learned counsel appearing for the petitioner submitted that the final report has been filed in this case, it cannot be considered as a change in circumstances. 5.

Considering the above facts, the nature of offence and if the petitioner is enlarged on bail, there is possibility of tampering of witnesses, hence this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 10.12.2025 stn K. RAJASEKAR, J.
