O R D E R

The petitioner, who was arrested and remanded to judicial custody on 08.11.2025, for the offences punishable under Sections 126(2), 296(b), 115(2), 311, 351(3), of BNS, 2023 in Crime No. 1175 of 2025 registered on the file respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused waylaid the de-facto complainant, threatened him and robbed a sum of Rs.200/- at knife point. Hence, the complaint was registered and the petitioner was arrested and remanded to judicial custody on 08.11.2025.

3. The learned counsel for the petitioner submits that the petitioner is in judicial custody from 08.11.2025. He further submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that though the petitioner was arrested and remanded to judicial custody since 08.11.2055, the property was recovered and this petitioner is having 8 bad antecedents viz., five cases u/s.307 of IPC and three robbery cases similar in nature. However, he vehemently opposed for grant of bail to the petitioner. 2/6

5. Considering the fact that the petitioner is having 8 bad antecedents and if the bail is granted to the petitioner he would indulge in similar activities in future, hence, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. 02.12.2025 MSM To 1.The Inspector of Police H-8, Thiruvottiyur Police Station Crime No. 1175 of 2025.
