ORDER
The petitioner presented a settlement deed dated 14.11.2025 for registration. The request for registration was declined under impugned refusal check slip dated 17.11.2025.
2. Learned counsel for the petitioner submits that the request for registration was refused by referring to the registration of documents by multiple persons and the registration of Court documents. He submits that the judgment and decree issued on the basis of a compromise relates to Survey No.387 of the extent of 1.88 acres. He contends that Survey No.387 had been sub divided much before the judgment and decree was issued into Survey No.387/1, 387/2 and 387/3. He relies on the 'A' Register reflecting the name of the petitioner's father.
3. Learned Special Government Pleader accepts notice for the respondent. By relying on written instructions, he submits that the settlement 2/4
includes Survey Nos.387/1 and 387/2, which are covered by the compromise decree. If an explanation were to be provided by the petitioner, he submits that the explanation may be accepted or, in the alternative, a speaking order would be issued.
4. As submitted by learned Special Government Pleader, it is open to the petitioner to explain as to why the settlement deed is not in the teeth of the compromise decree of the civil Court. Upon receipt of such explanation, after providing a reasonable opportunity to the petitioner, in the event of refusal, the respondent shall issue a speaking order under Section 71 of the Registration Act.
5. With these observations, this writ petition is disposed of. A decision in this regard shall be taken within one month from the date of receipt of a copy of this order. No costs.
