ORDER
(The Order of the Court was made by P.Velmurugan, J) This Habeas Corpus Petition has been filed to quash the detention order passed in Cr.M.P.No.42/Goonda/2025 dated 16.06.2025, by the second respondent and direct the respondents herein to produce the petitioner's brother namely Manikandan S/o.Lakshmanan (late), aged 26 years (who is presently undergoing detention in the Central Prison, Coimbatore), before this Court and set him at liberty on the ground of no public order is involved.
2. A perusal of records shows that the offence involved in the ground case is between private individuals and the offence has taken place within four walls and not in a public place in the presence of public. Therefore, no public order or public peace is involved. Hence, this Court is inclined to quash the detention order. 2 / 5
3. Accordingly, the order of detention passed in Cr.M.P.No.42/Goonda/2025 dated 16.06.2025, by the second respondent against the detenu namely Manikandan S/o.Lakshmanan (late), aged 26 years, is hereby quashed.
4. The detenu namely Manikandan S/o.Lakshmanan (late), is directed to be set at liberty forthwith, unless he is required in connection with any other case.
