Respondents PRAYER: Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or direction in the nature of writ, forbearing the respondents from infringing the petitioner's right to travel abroad by withdrawing the petitioner's Look Out Circular issued at the instance of the fourth respondent against the petitioner within the specific time frame as fixed by this Court.

The present Writ Petition (Criminal) has been filed seeking a direction to the respondents to withdraw the Look Out Circular pending 2/7
against the petitioner to enable him to travel abroad. 2.
It is submitted by the learned counsel appearing for the petitioner that initially, the petitioner was not arrayed as an accused at the time of registering the case in Crime No.234 of 2024. However, he was later implicated as one of the accused. Earlier, the petitioner had approached this Court in W.P.(Crl.)No.799 of 2025 seeking permission to travel abroad and this Court, vide order dated 10.09.2025, directed the respondents to suspend the Look Out Circular till 30.09.2025 to enable the petitioner to travel abroad and return. Pursuant to the said order, the petitioner complied with the conditions and returned to India before 30.09.2025. He further submitted that the petitioner now intends to travel abroad and will return within one month. Hence, he prayed for a suitable direction. 3.
Having heard the learned counsel appearing on either side and upon perusal of the materials available on record, this Court intends to grant permission to the petitioner to travel abroad, subject to certain 3/7
conditions.

Accordingly, on the petitioner filing an affidavit before the fourth respondent Police specifying the details of his proposed travel, including the place of visit, contact number, flight itinerary and date of return, the respondents are directed to suspend the Look Out Circular pending against him till 31.01.2025. The learned Additional Public Prosecutor shall ensure that necessary instructions are issued to the Police authorities concerned for communicating the petitioner's travel particulars to the Immigration Authorities.

With the above directions, this Writ Petition (Criminal) stands disposed of. No costs. Consequently connected miscellaneous petition is closed.
