ORDER

The petitioner, who was arrested and remanded to judicial custody on 1/6

17.11.2025, for the alleged offence punishable under Sections 275, 123 BNS r/w Sections 7(1), 20(2) of COTP Act, in Crime No.1166 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner along with other accused was found in possession of 104 kgs of banned tobacco products. Hence, the complaint was lodged and the petitioner was arrested and is in judicial custody.

3. Learned counsel appearing for the petitioner submitted that though the total quantity involved is 104 kgs of banned tobacco products, only 11.5 kgs is alleged to have been recovered from the petitioner. He further submitted that the petitioner is in judicial custody since 17.11.2025. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that 11.5 kgs of banned tobacco products was recovered from the petitioner. He further submitted that the petitioner joined hands with other accused was involved in illegal possession, transportation and sale of banned tobacco products at various places. He further submitted that the petitioner has two previous cases, similar in nature, pending against him. However, he opposed to grant bail to the petitioner. 3/6

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on both sides, the fact that the petitioner is involved in huge quantity of contraband and the fact that the petitioner has previous cases this Court is not inclined to grant bail to the petitioner.
