ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.10.2025 for the offences punishable under Sections 316(4) and 318(4) of BNS in Crime No.383 of 2025, registered on the file of the respondent police, seeks bail.

2.The allegation against the petitioner is that while the petitioner was working as a in-charge of collecting the sale proceeds from the dealers of Chengalpattu, Tambaram and Pallavaram, S.V.Koil, and Velachery South, during 11.05.2022 to 31.12.2024, the petitioner instead of remitting the funds to the company misappropriated Rs.24,98,069/- and hence a complaint was lodged and petitioner was arrested on 12.10.2025.

3.The learned counsel for the petitioner submitted that the petitioner is in judicial custody since 12.10.2025 and he has not committed any offence as alleged and almost all the amounts were repaid and since the petitioner is in custody, he is not able to produce the documents and to show his bonafide he is ready and willing to deposit a misappropriated money to the credit of Crime Number. Hence, he prayed for the grant of bail to the petitioner. 4.The learned counsel for the Intervenor submitted that all money collected were made to the UPI payments and other bank transactions and all these documents supports the receipt of money by the petitioner and however there is no remittance made by him and suddenly he left the job after misappropriation of money. Hence, he opposed for the grant of bail to the petitioner.

5.The learned Government Advocate (Crl.Side) for the respondent police reported that there are bank transactions and account statements revealed that this petitioner has collected huge amount and hence he was arrested and he is in judicial custody and the respondent is not able to recover any money and the investigation is still pending.

6.Considering the manner in which the occurrence had taken place and for the fact that huge amount has been misappropriated by the petitioner and so far the money is not recovered though the petitioner has come forward to deposit misappropriated money to the credit of Crime Number, this Court is not inclined to grant bail to the petitioner.
