O R D E R

The order passed by the second respondent in Memo No.1000009740/013496/G.59.G.592/2025 dated 20.11.2025, is put under challenge in the present Writ Petition.

2. Heard both sides. With the consent of both sides, the Writ Petition is taken up for hearing today at the admission stage itself.

3. The brief facts of the case is as follows: 3.1. The petitioner joined the first respondent Board as Junior Assistant in the year 2018 through direct recruitment and worked as Junior Assistant (Accounts) under the third respondent. Thereafter, he was promoted as Assistant (Accounts) in the year 2021 and then promoted as Accounts Supervisor and re-posted to Chennai South I EDC through Memo dated 19.08.2025 by the second respondent. On receipt of the said Memo, the petitioner made a representation addressing his grievances to the effect that he has to take care of his aged parents, daughters' education and also

that he had undergone a surgery due to an accident. Considering his representation, the second respondent issued Memo dated 11.11.2025, due to which, the third respondent vide Memo dated 12.11.2025 relieved the petitioner as Assistant Accounts from the fourth respondent and to join as Accounts Supervisor under the fifth respondent on 14.11.2025. Based on the same, the petitioner joined the fifth respondent office as Accounts Supervisor. While that being so, the petitioner received an email dated 20.11.2025 from the office of the second respondent in respect of his transfer to the sixth respondent office as Accounts Supervisor, without considering his representation dated 07.11.2025.

4. Aggrieved by the same, the petitioner has come forward with the present Writ Petition.

5. The learned counsel for the petitioner submitted that the petitioner

has met with an accident and undergone a surgery and also that he has to take care of his aged parents and to support his daughters in their studies, who are studying at 10 and 8 standard respectively at Erode. He further submitted that in case, if the petitioner's request cannot be considered, this Court may permit the petitioner to make a representation to the respondents in regard to his relinquishment to the promotional post so as to enable him to continue in the earlier post i.e., Assistant (Accounts) in the very same office.

In view of the above submissions made by the learned counsel for the petitioner, this Court grants liberty to the petitioner to make a representation to the concerned respondent in regard to his relinquishment of the promotional post and to retain him in the earlier post in the very same office, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondent concerned shall consider the same and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of the said representation. Till such time, the impugned order of transfer to the promotional post shall

be kept in abeyance.

7. With the above directions, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petitions are closed. There shall be no orders as to costs.
