ORDER
This writ petition is filed to direct the respondents to extend to the petitioner the benefits of the 7th pay Commission, including the enhanced gratuity with arrears and interest for the delayed payment, in accordance with G.O.Ms.No.303, Finance (Pay Cell) Department, dated 11.10.2017, G.O.Ms.No.313, Finance (Pay Cell) Department, dated 25.10.2017 and G.O.Ms.No.19, Higher Education (C2) Department, dated 14.01.2020.
2. By consent of both the parties, this writ petition is taken up for final hearing at the stage of admission itself.
3. The case of the petitioner is that the petitioner was retired from the third respondent/institute as Associate Professor on 31.05.2016. The Government of Tamil Nadu implemented the 7th Pay Commission through G.O.Ms.No.303, Finance (Pay Cell) Department, dated 11.10.2017, G.O.Ms.No.313, Finance (Pay Cell) Department, dated 25.10.2017 and G.O.Ms.No.19, Higher Education (C2) Department, dated 14.01.2020. Despite which, the benefits of the 7th Pay Commission, including enhanced gratuity have not be extended to the petitioner, though several similarly placed colleagues Page No.2 of 5
have been granted the same. Hence, he made a representation dated 31.10.2025 before the second respondent, seeking implementation of said Government Orders. However, the same was not considered, as on date. Hence, the petitioner has come forward with the present writ petition.
4. Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submits that, it would suffice, if this Court, issues a direction to the second respondent to consider the petitioner's representation dated 31.10.2025, as expeditiously as possible.
5. Learned Additional Government Pleader appearing for the respondents submits that, the petitioner's representation dated 31.10.2025 will be considered and appropriate orders will be passed within a time frame that may be stipulated by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 31.10.2025 Page No.3 of 5
and pass appropriate orders, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
