PRAYER: Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus or direction in the nature of writ, to direct the second respondent to provide police protection for the properties comprised in Survey Nos.144/1A1, 148/1C, situated at Mahanurpatti Village, Uthangarai Taluk, Krishnagiri District, based on the petitioner's complaint dated 13.11.2025 in C.S.R.No.493 of 2025 on the file of the third respondent.

The present Writ Petition (Criminal) has been filed seeking a direction to the second respondent to provide police protection for the petitioner's properties, based on the petitioner's representation dated 13.11.2025.
Mr.K.M.D.Muhilan, learned Additional Public Prosecutor, takes notice on behalf of respondents 1 to 3. In view of the consent expressed by the learned counsel on either side, this Writ Petition (Criminal) is taken up for final disposal at the 2/5
admission stage itself. Notice to respondents 4 to 10 is dispensed with inasmuch as no order prejudicial to their interest is passed. 4.
Learned counsel appearing for the petitioner submitted that respondents 4 to 10 unlawfully trespassed into the petitioner's property comprised in Survey Nos.144/1A1, 148/1C, situated at Mahanurpatti Village, Uthangarai Taluk, Krishnagiri District and caused destruction. Therefore, the petitioner sent several representations to the respondent police and on 13.11.2025, the third respondent registered a C.S.R.No.493 of 2025. However, thereafter, there has been no progress in the case. Hence, the present petition has been filed.

Learned Additional Public Prosecutor appearing for respondents 1 to 3 submitted that the petitioner and the counter parties are relatives and neighbouring land owners. Admittedly, civil suits are pending between them. He further submitted that based on the complaint given by the petitioner, an enquiry was conducted by the third respondent in C.S.R.No.493 of 2025 and the same was closed, as the dispute between the parties was found to be civil in nature and the parties were relegated to the civil court.

Recording the submissions made by the learned Additional Public Prosecutor, this Writ Petition (Criminal) stands disposed of. No costs. However, the petitioner is at liberty to challenge the closure report in the manner known to law, if so advised.
