ORDER

The petitioners who apprehend arrest for the alleged offences under Sections 303(2) of BNS Act (379 of IPC) r/w Section 21(1) Mines and Minerals (Development and Regulation) Act, in Crime No.366 of 2025 on the file of the respondent police, seeks anticipatory bail.

2.The allegations against the petitioners are that they, in collusion with other other accused, were involved in the illegal transportation of 4 units of Waste sand from Government poromboke land by using three lorries and one JCB. Hence, the case.

The learned counsel appearing for the petitioners would submit that the petitioners are innocent person and they have not committed any offence as alleged by the prosecution and falsely implicated in this case. He further submitted that the petitioners are ready and willing to furnish substantial sureties and to abide by any conditions that may be imposed by this Hon'ble Court and therefore, he prayed to grant anticipatory bail to the petitioners. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent opposed for granting anticipatory bail to the petitioners stating that they along with other accused had tried to illegally quarried Waste sand

from the Government promboke land by using three lorries and one JCB. Hence, he opposed to grant anticipatory bail to the petitioners.

Considering the nature of allegations, the submissions made by learned counsels on either side, and considering the fact that the petitioners are not only illegally quarried Waste sand but also caused damage to the ecology, therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
