This writ petition has been filed to direct the 1st respondent to furnish the judgment copy (Annexure to the Preliminary Order dated 04.11.2025 in O.A.No.7 of 2023) and consequently restrain the 2nd respondent from proceeding with any acquisition proceedings in respect of Survey No.82/2B2, Muttukadu Village, Chengalpet District, for a period of 30 days from the date of furnishing of the certified copy of the judgment. 2.Heard Mr.Srinath Sridevan, learned Senior Counsel for Mr.P.M.N.Bhagavath, learned counsel for the petitioner and Mr.S.Ravichandran, learned Special Government Pleader for the respondents 1, 7 to 9 and Mr.M.Murali, learned Government Advocate for the respondents 2 to 6.
3.The grievance of the writ petitioner is that the property, which belongs to the writ petitioner, is now sought to be acquired by the Government for the purposes of setting up of convention centre. The petitioner has initiated the proceedings under Section 63(b) before the Joint Commissioner, claiming to be the hereditary trustee. However, on enquiry, the Joint Commissioner has dismissed the Section 63(b) application filed by 3/7
the writ petitioner, rejecting the claim that the property is the private property of the petitioner and finding that it is the property belonging to the temple from 1911 onwards.
4.The grievance, however, of the writ petitioner is that the said decision of the Joint Commissioner has not been conveyed to the petitioner and unless the copy of the order is furnished to the petitioner, the petitioner is handicapped from even challenging the order before the Commissioner under Section 69 of the HR & CE Act.
5.Mr.S.Ravichandran, learned Special Government Pleader submits that the order was passed even on 04.11.2025 and however, he would fairly submit that the copy of the order has not been issued to the petitioner. In the light of the limited prayer sought for in the writ petition, with the consent of both the counsel, I am inclined to dispose of the writ petition even at the admission stage, with a direction that the 1st respondent to furnish a copy of the order dated 04.11.2025 in O.A.No.7 of 2023, expeditiously and within a period of two months, from the date of receipt of a copy of this order. The 2nd respondent shall not proceed with any acquisition proceedings for a 4/7
period of four weeks from the date of the order copy being furnished by the 2nd respondent, to enable the writ petitioner to move a revision and obtain an interim order before the Commissioner.
6.With the above direction, the Writ Petition is disposed of. No costs.
