PRAYER in W.P.No.46825 of 2025 : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondent to pay the petitioner a sum of Rs.75,487/- towards difference in gratuity with interest at the rate of 12% per annum within a specified time.

PRAYER in W.P.No.46832 of 2025 : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondent to pay the petitioner a sum of Rs.77,117/- towards difference in gratuity and to pay a sum of Rs.42,403/- towards difference in earned leave salary with interest at the rate of 12% per annum within a specified time.

C O M M O N O R D E R The relief sought for in W.P.Nos.46816, 46822 and 46832 of 2025 is for a mandamus seeking direction to the respondent to pay difference in gratuity and difference in earned leave salary with interest at the rate of 12% per annum, within a specified time frame fixed by this Court.

2. The relief sought for in W.P.No.46825 of 2025 is for a mandamus seeking direction to the respondent to pay difference in gratuity with interest at the rate of 12% per annum, within a specified time frame fixed by this Court.

3. The facts and circumstances and the issues involved in all the writ petitions are one and the same. Hence, this Court passes the common order.

4. The petitioners have joined as Conductor / Driver under the respondent Transport Corporation and they were retired from service as Checking Inspector and Selection Grade Senior Driver on attaining the age of superannuation during the year 2016 & 2017 respectively. But, the

respondent Corporation has settled the retirement benefits to the petitioners belatedly, without any interest. Further, they are entitled to get the benefits of pay revision as per 12(3) settlement and also other terminal benefits. Since the respondent did not calculate the Gratuity amount and leave salary based on the revised basic pay, they made representations dated 27.06.2025 and 29.05.2025 to the respondent and the same is pending without consideration. Therefore, the petitioners are before this Court seeking the above said relief.

5. The learned counsel appearing for the petitioners submits that it would suffice if this Court directs to respondent to consider the representations of the petitioner dated 27.06.2025 and 29.05.2025 within a reasonable time.

6. The learned counsel appearing for the respondent would submit that the representations of the petitioners will be considered and suitable orders will be passed.

In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the respondent to consider the petitioners' representations, dated 27.06.2025 & 29.05.2025 on the basis of 12(3) settlement and pass appropriate orders, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after giving an opportunity of hearing to the petitioners.

8. With the above direction, these Writ Petitions are disposed of. No costs.
