This application has been filed by the applicant/plaintiff seeking leave to sue the 1st Respondent/1st Defendant before this Court in the present suit. 2.

According to the applicant, he is the plaintiff in the main suit filed for Specific Performance and Permanent Injunction and the property is situated within the jurisdiction of this Court. The 1st defendant is residing outside the jurisdiction of this Court. It is further submitted that the cause of action has also arisen within the jurisdiction of this Court. Therefore, the applicant/plaintiff has filed the present application seeking leave to sue before this Court. 3.Heard petitioner side and perused the records.

4. Considering the above facts and circumstances of the case, and upon perusal of the reasons stated in the affidavit, and in view of the fact that the suit properties are situated within the jurisdiction of this Court and a substantial part of the cause of action has arisen within the jurisdiction of the Court, the 1st defendant is residing outside the jurisdiction of the Court and on perusing the materials on record, this application is allowed. Leave is granted.

5. The Registry is directed to number the Civil Suit, if it is otherwise in order.
