ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.08.2025, for the offences punishable under Sections 392, 397, 450 & 506(ii) of IPC in S.C.No.340 of 2024 registered on the file of respondent police, seeks bail.

2.The allegation against the petitioner is that earlier he was arrested and released on bail and subsequently, he appeared regularly before the Trial Court. On 11.12.2024, he has not appeared before the Trial Court due to his ill-health. Thereafter, Non Bailable Warrant was issued to the petitioner on 11.12.2024 and the same was executed on 22.08.2025. 3.The learned Counsel for the petitioner submits that the petitioner is facing the prosecution of two cases, he appeared regularly before the Trial Court in both the cases. In this case, the petitioner was not properly intimated by his Counsel and he was misguided, therefore, he was unable to 2/8

appear before the Trial Court and is ready to abide any condition imposed by this Court.

4.The learned Government Advocate [Criminal Side] appearing for the respondent police while opposing the bail to the petitioner, reiterated the prosecution case and submits that now, the case is posted for framing of charges. He further submits that two cases are pending, in which one case is u/s.302 IPC pending against him.

5.Considering the submissions made by the learned Counsel for the petitioner; it seems that the petitioner regularly appeared in other case; that the period of incarceration of the petitioner in this case from 22.08.2025; I am inclined to grant bail to the petitioner with certain conditions. 3/8

6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Sessions Judge, Mahalir Neethimandram/Additional Special Court for Exclusive Trial of Cases under Protection of Children from Sexual Offences Act at Coimbatore District, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] that the petitioner shall report before the learned Sessions Judge, Mahalir Neethimandram/Additional Special Court for Exclusive Trial of Cases under Protection of Children from Sexual Offences Act at Coimbatore District, daily at 10.30 am for a period of three weeks. 4/8

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the 3 rd petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
