ORDER

The petitioner, who was arrested and remanded to judicial custody on 17.10.2025 for the offences punishable under Sections 8(c), 20(b)(ii)(B) &

29(1) of NDPS Act, 2023 in Crime No.161 of 2025, registered on the file of the respondent police, seeks bail.

The allegation against the petitioner is that the petitioner, in collusion with other accused, was involved in the transportation of 15 kgs of Ganja from Andhra Pradesh to Tamil Nadu. They were intercepted while transporting, and at the time of arrest, A1 was carrying 10 kgs of Ganja and A2 was carrying 5 kgs of Ganja. Hence, two, separate seizures were effected and the contraband was seized. Hence, the case.

2.The learned counsel for the petitioner submitted that the petitioner was found in possession of 10 kgs of Ganja and he has been in judicial custody since 17.10.2025. He further submitted that the petitioner has been falsely implicated in this case. Hence, he prayed for the grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) for the respondent police reported that the petitioner, apart from this case, has a similar case in Crime No.4 of 2025 on the file of R.K.Pet Police Station, and he is a habitual offender. If released on bail, he will indulge in similar offences. Hence, he opposed for the grant of bail to the petitioner.

5.Though it is stated that the contraband seized in this case is not a

commercial quantity, as far as the petitioner is concerned, 10 kgs of Ganja has been recovered, and the petitioner also has one previous case of a similar nature. If the petitioner is released on bail, he will indulge in similar kinds of offences. This Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 03-12-2025 gbi
