This Miscellaneous Petition has been filed seeking to condone the delay of 27 days in filing the above Civil Revision Petition against the fair and decretal order dated 06.03.2024 passed in I.A.No.487 of 2014 in O.S.No.95 of 2011 on the file of the Subordinate Court, Katpadi, Vellore District.
2.Mr. M. Satish Kumar, learned counsel, undertakes to enter appearance on behalf of the first respondent. The second respondent has been served; however, there is no representation either in person or through counsel.
3.The learned counsel for the first respondent sought time to file a counter affidavit. However, upon being informed that the delay in preferring the revision is only 27 days, the learned counsel confined his request to printing the name of the counsel for the first respondent when the Civil Revision Petition is listed for admission. 1/3
4.This Court has considered the submissions made and has perused the affidavit filed in support of the petition seeking condonation of delay of 27 days in filing the Civil Revision Petition. The petitioner has set out sufficient and acceptable reasons for not preferring the revision within the prescribed time.
5.In view of the above, this Court is satisfied that the petitioner has made out a case for condonation of delay and that no serious prejudice would be caused to the respondents. Accordingly, this Miscellaneous Petition is ordered as prayed for.
