COMMON ORDER It appears that the appellant had filed another Criminal Appeal No.1431 of 2024 through the legal-aid counsel, Mr.C.S.S.Pillai.

2. Mr.J.Sathiya Vimal has been engaged by the appellant to file an appeal and has filed the appeal in Crl.A.SR No.65433 of 2025 along with a miscellaneous petition in Crl.M.P.No.23965 of 2025 in Crl.A.SR No.65433 of 2025, seeking to condone the delay of 1375 days in filing the criminal appeal.

3. The appellant is permitted to withdraw the miscellaneous petition in Crl.M.P.No.23965 of 2025 in Crl.A.SR No.65433 of 2025, filed to condone the delay of 1375 days in filing the criminal appeal, and to prosecute the appeal filed through Mr.C.S.S.Pillai, which has been numbered as C.A.No.1431 of 2024.

4. Mr.C.S.S.Pillai has given consent to Mr.J.Sathiya Vimal to pursue C.A.No.1431 of 2024.

5. In view of the above, the earlier order dated 12.01.2026 passed in Crl.M.P.SR No.23965 of 2025 in Crl.A.SR No.65433 of 2025, condoning the delay of 1375 days in filing the criminal appeal, is recalled, and the criminal

miscellaneous petition in Crl.M.P.No.23965 of 2025 in Crl.A.SR No.65433 of 2025 is dismissed as withdrawn.

6. List the Criminal Appeal in C.A.No.1431 of 2024 for final hearing in the usual course.
