ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120B, 344, 370 & 420 of IPC BNS, 2023 in Crime No. 3 of 2024 on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner along with other co-accused had collected to the tune of Rs.4,88,000/- from the de-facto complainant and other 7 victims under the pretext of getting job in Abroad and thereafter, they failed to return back the money and cheated the de-facto complainant and other victims. Hence the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He also submitted that the petitioner is also ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner is still Abroad and he has not returned to India. He opposed to grant anticipatory bail to the petitioner.
5. Considering the fact that the petitioner is still Abroad, I am not inclined to entertain this petition and accordingly, this Criminal Original Petition stands dismissed.
