ORDER

The petitioner, who was arrested and remanded to judicial custody on

14.07.2025 for the alleged offences under Sections 8(c), 20(b)(ii)(C) and 29(1) of NDPS Act in Cr. No.143 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused have involved in illegal sale of Ganja near Gandhi Nagar Bus Depot, Adyar. Total contraband seized from the accused is 26 kgs. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent, she has not committed any offence as alleged by the prosecution and she has been falsely implicated in this case. He would further submit that even according to the prosecution, 11 kgs of Ganja has been recovered from the petitioner, which is not a commercial quantity. The petitioner is under incarceration since 14.07.2025 and the earlier bail applications filed by the petitioner were dismissed and there are change of circumstances. Charge sheet has also been filed. He further submits that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.

4. The said contention of the learned counsel appearing for the petitioner has been strongly opposed by the learned Government Advocate (Criminal side) appearing for the respondent police stating that total quantity involved in this

case is a commercial quantity and the petitioner is having one previous case registered in Rajamundry Policec Station Cr. No.25 of 2023 under Sections 8(c) read with Section 20(b)(ii)(C) of NDPS Act and in that case also, commercial quantity of contraband has been involved.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the submissions made by the learned Government Advocate that commercial quantity of contraband involved in this case and taking into consideration the bad antecedent of the petitioner, this Court is of the view that there is no merits in the petition. In view of the same, it is not desirable to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 12-03-2026 [1/2] MJS
