O R D E R

The petitioner, who was arrested and remanded to judicial custody on 05.11.2025, for the alleged offence punishable under Sections 274, 275, 123, 111 of BNS Act r/w Section 24(1) of COTPA Act, in Crime No.323 of 2025, on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner is arrayed as A1 in this case. It is alleged that the petitioner joined hands with three other accused, was involved in transporting 476 kilograms of banned tobacco products from Karnataka to Puducherry. During transit, they were intercepted by the respondent police, the contraband was seized, and the petitioner was arrested. Hence, the present complaint was lodged.

3. Learned counsel appearing for the petitioner submitted that the petitioner has been in judicial custody since 05.11.2025; that the contraband has already been seized; and that the petitioner is willing to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are totally six accused in this case and the petitioner is arrayed as A1. He further submitted that the petitioner hails from the State of Telangana; that no previous cases are pending against him; and that A4 to A6 are still absconding. Hence, he opposed the grant of bail to the petitioner.

5. Considering the fact that some of the accused are still absconding, the investigation is still pending, and the petitioner was arrested only recently, this Court is not inclined to grant bail to the petitioner. 2/4
