ORDER
This writ petition (criminal) has been filed, forbearing the 2nd respondent from harassing the petitioners on the basis of the complaint of the 3rd respondent dated 07.11.2025 by considering the petitioners' representation dated 18.11.2025.
2. When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents 1 and 2 submitted that based on the complaint given by the third respondent, enquiry is being conducted in Current Paper No.1710 of 2025. The second respondent after issuing appropriate summons, had directed the petitioners to appear for the enquiry. The petitioners had appeared for enquiry on 25.11.2025 and undertaken to furnish the documents. However, they have not turned up at all and have filed this petition.
3. Such being the position, it is for the Investigating Agency to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioners shall appear for enquiry and cooperate in the investigation. It is made clear that the petitioners shall not be harassed during the course of enquiry. If any cognizable offence is made out, the respondent Police shall register a First Information Report and proceed in accordance with law.
4. Accordingly, this writ petition (criminal) stands disposed of with the aforesaid direction. Consequently, connected W.M.P.Crl.No.752 of 2025 is closed.
5. Insofar as W.M.P.Crl.No.751 of 2025 filed seeking permission to the petitioners to file a single writ petition jointly is concerned, the petition is ordered on payment of single Court fee.
