ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.10.2025 for the offences punishable under Section 303(2), 326 of BNS, 2023 [Corresponding to Sections 379, 430 of IPC] in Crime No. 304 of 2025, on the file of the respondent Police, seeks bail.

2. The allegation against the petitioner is that the petitioner along with other accused quarried and transported 1/4 unit of river sand using bullock cart without any valid licence from the Government. Based on the complaint, the petitioner was arrested on 09.10.2025.

3. The learned Counsel for the petitioner submits that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. He further submits that the petitioner was arrested and remanded to judicial custody from 09.10.2025. He also submits that the petitioner is ready to abide by any condition imposed by this Court and he prayed to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the proclamation case and submits that totally two accused involved in this case. He further submits that the petitioner is having 29 previous case, out of which, 17 cases are similar in nature, one case u/s.302 of IPC and one robbery case u/s.399 of IPC. Therefore, he opposed for grant of bail to the petitioner. 2 / 4

5. I have also gone through the FIR and other connected records which reveals that the petitioner is a habitual offender and if bail is granted to the petitioner, he would indulge in similar offences in future and hence, I am not inclined to grant bail to the petitioner.
