ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.09.2025, for the alleged offence punishable under Sections 305(a), 331(4) of BNS, 2023 in Crime No.367 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he is arrayed as A2 in this case and that he joined hands with three other accused and committed dacoity, and taken a sum of Rs.7,50,000/- from the school office. Hence, a case was registered and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 08.09.2025 and that, though certain previous cases have been cited against him, those cases have already ended. He further submitted that a part of the stolen amount has also been recovered. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that out of Rs.7,50,000/-, a sum of Rs.3,50,000/- has been recovered. He further submitted that the petitioner has eight previous cases, out of which six cases are similar in nature, while the remaining two are of a different nature. He also submitted that the investigation has not yet been concluded. Hence, he opposed the grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on both sides and the fact that the petitioner is having bad antecedents, this Court is of 2/4

the view that, at this stage, if the petitioner is released on bail, there is a likelihood of his indulging in similar activities. Therefore, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition is dismissed. 04.12.2025 drl To
