The present Criminal Original Petition has been filed seeking to set aside order passed by the learned Judicial Magistrate No.II, Krishnagiri, dated 01.11.2025, in Crl.M.P.No.2239 of 2025. 1/5

The submissions of the learned counsel appearing for the petitioner are as follows:- 2.1. The petitioner is arrayed as an accused in Crime No.6 of 2024 registered for the offences under Section 406, 420, 465, 468 and 471 of IPC.

2.2. On 20.09.2024, the petitioner was arrested and later, he was granted bail by the Judicial Magistrate Court No.II, Krishnagiri, on 19.11.2024 in Crl.M.P.No.7951 of 2025, with a condition to appear before the respondent Police on the 1st day of every month. 2.3. Thereafter, the petitioner has filed a petition in Crl.M.P.No.2339 of 2025 seeking relaxation of the said condition. However, the learned Magistrate dismissed the same, vide order dated 01.11.2025. 2.4. As on date, the investigation in this case has been completed, the final report has been filed and the same has been taken cognizance of on the file of the Chief Judicial Magistrate, Krishnagiri, in C.C.No.913 of 2025. Further, the petitioner undertakes to appear before the trial Court on the next hearing date without fail. 3.

Learned Government Advocate (Criminal Side) submitted that the investigation in Crime No.6 of 2024 was completed and the case was 2/5

taken up for trial on the file of the learned Chief Judicial Magistrate, Krishnagiri, in C.C.No.913 of 2025. He further submitted that the case now stands posted on 05.02.2026 for appearance of the petitioner. 4.

Having heard the learned counsel appearing on both sides and upon perusal of the materials available on record, this Court is inclined to relax the condition imposed in Crl.M.P.No.7951 of 2025 vide order 19.11.2024.

Accordingly, this Criminal Original Petition stands allowed. The order passed by the learned Judicial Magistrate No.II, Krishnagiri, in Crl.M.P.No.2239 of 2025 on 01.11.2025 is hereby set aside and the petitioner is directed to appear before the trial Court on the next hearing date i.e., on 05.02.2026, without fail.
