O R D E R

This Contempt Petition is filed alleging willful disobedience of the order of this Court dated 24.11.2023 in W.M.P.No.32865 of 2023 in W.P.No.33170 of 2023.

2. When the contempt petition is taken up for hearing, the learned counsel for the petitioner submits that this Court had granted interim stay of the impugned proceedings of the respondents dated 02.11.2022.

3. The learned counsel for the petitioner further submitted that the respondents in violation of the order of interim stay granted by this Court and are now taking up the staff fixation by the proceedings of the second respondent which action of the respondents clearly amounts to willful disobedience of the order of this Court.

4. I have taken note of the above contentions urged and perused the records. This Court by an order dated 24.11.2023 had granted interim stay till 04.01.2024.

5. Admittedly, the petitioner did not take any steps for getting aforesaid stay extended, atleast by filing a petition, even though the writ petition was not listed. Further, as the writ petition is pending, if the respondents are violating the order of this Court or taking any action thereby making the writ petition infructuous, the petitioner ought to have filed a miscellaneous petition in the pending writ petition for obtaining further orders in the matter.

6. The petitioner did not take any of the aforesaid steps as noted hereinabove.

7. In view of the above, granting liberty to the petitioner to move necessary application in pending writ petition, this Court is of the view that the contempt petition cannot be proceeded with.

8. Accordingly, this Contempt Petition is closed. 20.02.2026 dh 3/5
