Petition filed under Section 528 of BNSS, 2023, to transfer the investigation in Crime No.122 of 2025 from the file of the 3rd respondentpolice to a competent and investigation agency such as CBCID/District Crime Branch, in the interest of justice by appreciating the above stated facts and circumstances.

ORDER
This criminal original petition has been filed seeking transfer of the investigation in Crime No.122 of 2025 from the file of the third respondentPolice to the CBCID/District Crime Branch.
2. Alleging that the investigation in Crime No.122 of 2025 has not been conducted in a fair and proper manner, the petitioner seeks the aforesaid relief.
3. The learned counsel for the petitioner submits that though the petitioner has given a written complaint regarding the theft of her gold chain before the respondent / Police, the investigation has not been properly conducted.
4. Per contra the learned Government Advocate (Crl.Side) appearing 2/4
for the respondents / Police submits that the investigation is in progress and is being carried out in a fair and proper manner including collection of CCTV footage and efforts to identify the offenders.
5. Heard the learned counsel appearing on either side and perused the materials available on record.
6. Considering the facts and circumstances of the case, this Court does not find any infirmity in the investigation conducted by the respondents. However, there shall be a direction to the third respondent to proceed with and complete the investigation and the second respondent is directed to monitor the same.
7. With the above directions, this criminal original petition stands disposed of.
