ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus forbearing the respondents, their men, agents, subordinates or any person claiming under them from in any manner installing any High Tension Electricity Tower or fixing High Tension Electricity Lines through the petitioners agricultural land in Survey No.1029, Alampalayam-Sirukinar Village, Dharapuram Taluk, Tirupuur District, by considering the petitioner's representations dated 29.07.2023 and 27.11.2025.

The learned counsel for the petitioner submits that the petitioner is the absolute owner of agricultural land measuring 2.98 acres in S.No.1029, Alampalayam-Sirukinar Village, Dharapuram Taluk, Tiruppur District and he also holds patta in his favour in Patta No.1906. On 07.07.2023, certain contract labourers engaged by the respondents entered into his land and informed him that they had come to take measurements for erecting 750 KV High Tension Transmission Towers and for drawing overhead power lines.

Aggrieved by the same, the petitioner made a detailed representation on 29.07.2023 to the respondents including the District Collector, Tiruppur District, and the District Collector thereafter, forwarded the petitioner's representation to the third respondent on 08.08.2023 for further action. However, the third respondent has not taken any action till date.

4. In the meanwhile, the respondents Electricity Board, are attempting to trespass into the petitioner's land for erecting the tower and fixing high voltage electricity lines. Hence, the petitioner submitted another representation before the respondents dated 27.11.2025, but, the same has not been considered. Therefore, the petitioner is constrained to file the present Writ Petition.

5. The learned counsel appearing for the respondents submits that this Court may issue a direction to the respondents to consider the petitioner's representation and pass an appropriate order.

6. Heard the learned counsel appearing for the petitioner as well as the respondents and perused the materials placed before this Court.

Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the second respondent / Chief Engineer, Tamil Nadu Generation and Distribution Corporation Ltd., Annasalai, Chennai, to consider the petitioner's representation dated 29.07.2023 and 27.11.2025 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner and also affording him an opportunity of personal hearing, within a period of two (2) weeks from the date of receipt of a copy of this order. Till such time, the respondents are restrained from carrying out any work in the petitioner's land.

8. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
