ORDER

Impugned refusal check slip dated 19.11.2025 is challenged in this writ petition.

2. Learned counsel for the petitioner submits that the land is classified as agricultural land and that the impugned order is untenable inasmuch as the refusal is on the ground that it is an unapproved house site.

3. Mr.U.Baranidharan, learned Special Government Pleader appears on behalf of the sole respondent. He submits that the petitioner may raise objections to the refusal check slip and that a speaking order would be issued under Section 71 of the Registration Act, 1908.

4. The impugned order records "unapproved/not regularised house site". No further particulars are contained in the said order. The petitioner asserts that it is agricultural land and does not form part of unapproved house site. Given the fact that the order does not record reasons for the conclusion therein, said order cannot be sustained and is set aside. As a consequence, the matter is remitted to the respondent for re-consideration. After providing a reasonable opportunity to the petitioner, a speaking order shall be issued within one month from the date of receipt of a copy of this order. 2/4

5. The writ petition is disposed of on the above terms. There shall be no order as to costs.
