ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.09.2025 for the offences punishable under Sections 406, 420, 464, 465, 467, 468, 471, 506(1) of IPC, in Crime No.1 of 2024, registered on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner joining hands with 4 other accused involved in fabrication of power of attorney for the land belongs to one Nagaraj, who is the original owner. Subsequently on the strength of power of attorney the property was settled in the name of wife of this petitioner. Thereafter, power of attorney was executed in favour of the defacto complainant and subsequently sale deed was also executed by the defacto complainant in favour of his wife. After taking possession while the defacto complainant attempted to put up construction, the original owner Nagaraj intervened and stopped the construction work. Thereafter it revealed that this petitioner involved in fabrication of records and sold the property. Hence this case.

3. The learned counsel appearing for the petitioner submitted that totally 5 accused in this case, the allegation levelled in the FIR is only against A1 to A4, 2/5

already A2 and A3 arrested and released on bail and the petitioner is under incarceration nearly 85 days. Hence he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that totally 5 accused in this case, A4 is still absconding, investigation is pending and opposed for grant of bail to the petitioner.

I have also gone through the records, it revealed that this petitioner who was ranked as A5 plays a vital role in fabrication of records impersonation and also was benefitted from the sale consideration. I am of the view, that the petitioner is the main accused in this case and if he is released on bail, it will hamper the investigation, hence this Court is not inclined to grant bail to the petitioner at this stage.
