This application has been filed to condone the delay of 187 days in filing the written statement of the second defendant.
2. According to the applicant, he is the second defendant in the main suit and the respondents have filed the suit for settling a scheme of amalgamation of the defendant Trusts into a single unified entity. After receipt of summons, the applicant filed an application in A.No.2629 of 2025 to revoke the leave, and the same was dismissed by this Court on 19.09.2025. Against the said order, the applicant preferred an appeal in O.S.ANo.336 of 2025 and the same was also dismissed, thereby he was unable to file the written statement. Therefore, the delay of 182 days occurred in filing the written statement.

4. Considering the said reasons stated in the affidavit filed in support of this application, and in order to give a fair chance to the applicant to effectively defend the suit, this application is allowed and the delay of 187 days is hereby condoned.
